The Supreme Court of Kenya ruled on Friday (January 27th) that in the case of divorce, each party must leave the marriage with property equal to the contribution of each party.
The court held that spouses are not automatically entitled to half of the marital property upon separation. The petition to the High Court arose out of a divorce dispute between Joseph Ombogi Ogentoto and his wife Martha Bosibori.
Ogentoto took the case to the Supreme Court after the Court of Appeal ordered that the house he and his 18-year-old wife live in and the rental house be shared equally between them on a 50:50 basis. Friday's Supreme Court ruling will become future guidelines for the division of marital property between divorcing spouses.
